These terms and conditions provided by ToyFrenzi set the terms and conditions under which you may use our website. Your use of this website constitutes acceptance of these terms and conditions. If you do not accept the terms and conditions, then you may not use the website. IF YOU'RE UNDER THE AGE OF 18, kindly obtain your parent or guardian’s consent before using the Website – as this User Agreement and your use of the Website affect their legal rights and obligations.
Changes to these terms and conditions will come into effect as soon as they are posted on the website. We reserve the right to close any, or all, of the website at any time, and to alter or correct any website content, with or without prior notice. The price you pay will be the price indicated at the time the order is placed. Should there be a mistake from our end, you will be advised accordingly and you will have the option to either retain the order or to cancel your order.
Contract of Sale
Any sale through the www.toyfrenzi.com website is deemed to have occurred within the Maltese jurisdiction and therefore Maltese law shall apply. All contracts of sale are concluded in the English language.
Right of Withdrawal
Unless one of the exceptions listed below applies, you can cancel your order without giving any reason within 14 days from the day on which you or a third party indicated by you (other than the carrier) receives the goods purchased (or last good, lot or piece if it relates to goods or multiple lots or pieces delivered separately) or from the day of the conclusion of the contract, in the case of services or digital content not supplied in a tangible medium (e.g. CD or DVD).
You must inform us (Mizzons Ltd, 1, Mario Agius Street, Lija, LJA 1420, Malta.) of your decision to cancel your order. You may submit your request by mail(traditional mail or E-Mail) or through our Returns Form. To meet the cancellation deadline, it is sufficient for you to send your communication before the 14 days’ cancellation period has expired and return the item.
We will reimburse all payments received from you for the goods purchased and will also reimburse delivery charges for the least expensive type of delivery offered by us, no later than 14 days from the day on which we received the above communication and/or the returned items. We will use the same means of payment as you used for the initial transaction, unless we have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
Note that you will have to bear the direct cost of returning these goods. You may be liable if the value of the goods returned diminishes due to the handling of the goods (except when it was necessary to establish the nature, characteristics and functioning of the goods).
The right of cancellation does not apply to:
- the delivery of products which are not suitable for return due to health protection or hygienic reasons if unsealed by you after delivery, or which are, after delivery, inseparably mixed with other items;
- the delivery of sealed audio or video recordings or of sealed software if unsealed by you after delivery;
- the supply of goods made to your specifications or clearly personalized;
- the supply of goods which may deteriorate or expire rapidly;
- a service if Amazon has fully performed it and you accepted when you placed your order that we could start to deliver it, and that you could not cancel it once delivery had started;
- the supply of digital content (including apps, digital software, ebooks, MP3, etc) which is not supplied on a tangible medium (e.g. on a CD or DVD) if you accepted when you placed your order that we could start to deliver it, and that you could not cancel it once delivery had started;
- the delivery of newspapers, journals or magazines with the exception of subscription contracts.
Description of Products
Each product on this website is listed subject to its Product Description. We take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was uploaded on the website.
The price displayed on the website may differ from the price for the same item sold in other stores. The price charged to customers is inclusive of VAT. We will endeavour to acknowledge all orders by return mail. However this does not imply that we are confirming your order.
Aquitium Ltd reserves the right to cancel any order or part thereof in situations where the product description is erroneous and/or the listed item/s are no longer available. In such situations a full refund will be given.
On Shelf Promise
Certain products are available in assorted colours or characters. We cannot guarantee that your preferred colour or character within such assorted products will be available when you place your reservation. In such circumstances an alternative colour or character will be placed in reservation for you. You will be given the option to change the item as long as these are in stock.
We are happy to exchange or refund items if returned within a considerate time, provided the goods are unused, unopened. Kindly retain the original packaging. A valid receipt should accompany the claim. Your receipt is your proof of purchase and your warranty.
We accept payment through PayPal. Customer credit card information is not stored by us on our servers. Payment should be made in EUROS. Prices are subject to 18% Value Added Tax. Cash or cheques against presentation of Identity Cards will be accepted if customers are picking up items.
Delivery and Payment
If no date is specified for delivery of the Goods, delivery shall be within a reasonable time at the specified address. Alternatively, you may choose to collect items from us. Kindly let us know at time of ordering. It is advisable that the person collecting the item will be the same customer placing the order. Ownership in the Goods shall pass to the Buyer once full settlement of the items is made. Payment shall not be deemed to have taken place until the receipt by Mizzons Ltd. of cleared funds. Payment should be effected strictly upon delivery.
You agree that:
- any information provided by you will be true, accurate, current and complete
- confirm that you are the authorised holder of any credit/debit card you may use on the website
- to notify us immediately of any changes to any information you have submitted to the website
Mizzons Ltd. warrants that the Goods are of satisfactory quality.
Defective goods or goods not in conformity with the contract of sale are covered under the two year legal guarantee as established in regulation 78 of the Consumer Affairs Act.
If the Buyer wishes to make a claim under this warranty, the Buyer shall give written notice to the Company within 60 days of the discovery of the defect and give the Company a reasonable opportunity to inspect the Goods in question. The Company shall not be liable for any breach of warranty if the Buyer makes any further use of the Goods after giving such notice or alters or repairs the Goods without the agreement of the Company. The Company’s liability under the warranty shall be limited to repairing or replacing the Goods in question or refunding the price of such Goods.
